Novelty Distributors, Inc. (“Novelty”), challenges the pre-hearing suspension by the Drug Enforcement Agency (“DEA”) of Novelty’s registration to distribute ephedrine and pseudoephedrine, both of which are list I chemicals subject to DEA regulation. It seeks a preliminary injunction enjoining the suspension pending a final decision by DEA.
