NEESE, District Judge.

A United States magistrate of this district recommended that the Court grant the motion of July 1, 1977 of the plaintiff Ter rell Oil Corporation for a summary judgment, Rule 56(a)° Federal Rules of Civil Procedure, as to its status herein as a “wholesale purchaser-reseller” under the provisions of 10 C.F.R. § 211.51. 28 U.S.C. § 636(b)(1)(B).
