The plaintiff in error instituted an action at law against the defendant in error in which it was sought to recover on a contract for personal services to be rendered to the defendant by the plaintiff, but which services were not so rendered by reason of the fact that the defendant failed and refused to employ the plaintiff, in accordance with the terms and provisions of the contract.
