—The first ground of the demurrer that the allegations of the declaration do not piesent a cause of action, does not state any substantial matter of law challenging the sufficiency in substance of the' declaration as required by the statute, and is in effect but a repetition or reiteration of the statutory form of demurrer that the declaration “is-bad in substance.” As it does not appear from an inspection of the declaration that it in substance fails to state a cause of action the first ground of the demurrer is of no avail.
