This is an appeal from a district court’s order affirming a magistrate’s dismissal of Kenneth Brennan’s petition for a writ of habeas corpus. We affirm.

The relevant facts and procedural history of this case are as follows. In January, 1988, Brennan was sentenced by the District Court of the Second Judicial District for Nez Perce County, to two concurrent sentences of fifteen years for convictions on two counts of attempted robbery.
