This action was commenced in the district court of. Creek county, Okla. by S. B. Dies, plaintiff’ in error, plaintiff below, against the Bank of Commerce of Sapulpa. a corporation, defendant in error, defendant below, to recover tlie sum of $2,700 claimed to have been paid by plaintiff in error to defendant in error in violation 'Of the usury laws of the state of Oklahoma.
The parties to this action will be referred to as plaintiff and defendant in this opinion as they appeared in the lower court.
