Appeal by defendant from a judgment of the Supreme Court, Suffolk County (Mclnerney, J.), rendered November 28, 1984, convicting him of grand larceny in the third degree, petit larceny, and issuing a bad check (two counts), upon a jury verdict, and imposing sentence.

Judgment affirmed and case remitted to the Supreme Court, Suffolk County, for further proceedings pursuant to CPL 460.50 (5).
