Ronald E. Chapa filed this action in 1981 in the United States District Court for the Southern District of Alabama against Local 18 of the Industrial Union of Marine & Shipbuilding Workers of America, AFL-CIO, the national union, and several officials of both organizations. The complaint charged the defendants with violations of Sections 101(a)(2) and (5) of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA), 29 U.S.C. §§ 411(a)(2) and (5), following Chapa’s five-year suspension from membership in the local union.
