Plaintiff Builders Association of Greater Chicago (“Builders Association” or “Association”) has brought this § 1983 action against defendant City of Chicago claiming that Chicago’s Minority-owned and Women-owned Business Enterprise Procurement program (“M/WBE” program) discriminates against non-minority businesses in violation of the equal protection clause of the Fourteenth Amendment.
