OPINION
BASSLER, District Judge:
Defendant, Woodhaven Condominium Association, Inc. (the “Association”), moves for summary judgment dismissing the Complaint in this action. The Plaintiff, Albert Gittleman (“Mr.Gittleman”), has not submitted opposition to this motion despite the Court’s invitation to do so. (See Letter Dated July 22, 1997 From William G.
