Katrina Watts (“Plaintiff”) filed a multiple count suit against Raymond Sechler (“Defendant”) claiming that she was damaged when hay bought from Defendant poisoned her dairy cattle. Before trial, the court dismissed Count IV of Plaintiffs petition (based on the res ipsa loquitur doctrine) because it failed to state a claim for which relief could be granted. Later, during a jury trial and at the conclusion of Plaintiffs evidence, a verdict was directed in Defendant’s favor. This appeal followed.
