Plaintiffs sued to recover a portion of a fee received by the defendants for negotiating the sale of certain real estate situated in the city of Los Angeles. Defendants answered, denying liability; a trial was had upon the issues joined, and judgment was given in favor of defendants. From this judgment plaintiffs appeal.

The court found that on the twenty-sixth day of January, 1909, the plaintiff copartnership and the defendant Cal F. Hunter entered into a contract which was in the following words and figures:
