Introduction

Plaintiff, Framarz Froudi, alleges in his complaint that the United States Drug Enforcement Administration (DEA) conducted forfeiture proceedings of his automobile and briefcase in violation of his statutory and constitutional rights. The complaint seeks equitable declaratory and injunctive relief, as well as just compensation for the taking of said property. The case is before the court on defendant’s motion to dismiss plaintiff’s complaint for lack of subject matter jurisdiction. For the reasons set forth below, the court will stay consideration…
