Defendant Giovanni Rios, one of three codefendants charged with criminal sale of a controlled substance in the third degree (Penal Law § 220.39 [1]), has moved for dismissal of the indictment pursuant to CPL 30.30. Most of the time to be charged to the prosecution is not in dispute.
