The principal questions presented by this appeal are (1) whether a gift causa mortis of a. deposit in a savings bank can be effected by the mere delivery to the donee of the passbook issued by the bank to the donor as evidence of his title to the same, where the donor sufficiently indicates an intention of assigning or transferring the fund to the donee but executes no written order for the transfer or assignment thereof; and (2) whether, assuming that such a gift can bo validly made in that manner, the evidence in this case is sufficient to support a finding that one Alton Brooks, late of…
