(after stating the facts as above). The case at bar is one of unusual history. At the time this petitioner was tried the territorial penitentiary was .at Lansing, Kan. His case was appealed to the Supreme Court of Oklahoma Territory, and the appeal dismissed. After his appeal had been dismissed by the Supreme Court of • the territory, and while in the .territorial prison at Lansing, Kan., he applied to the Supreme Court of Kan sas for a writ of habeas corpus as reported in 65 Kan. 547, 70 Pac. 354.
