Upon petition to this court for a writ of habeas corpus, filed for the purpose of setting at liberty P. M. Sullivan, a writ was granted, returnable before this court. February 3, 1914.
It is averred in the petition that petitioner “is now and has been since January 28, 1914, illegally, unlawfully, and unconstitutionally restrained of his liberty and confined in the county jail of Oklahoma county by M. C. Binion, the sheriff of said county.”
