We are considering the parties’ cross motions for summary judgment.
I. BACKGROUND
Plaintiff, Caterpillar Inc. (“Caterpillar”), is engaged in the manufacture, sale, and distribution of heavy equipment at plants throughout the United States, including a facility in York, Pennsylvania.
