On November 13, 2002, Plaintiff Smith & Nephew, Inc. (“Smith & Nephew”) sued Defendants Synthes (U.S.A.) and Synthes-Stratec, Inc. (collectively, “Synthes”) for infringement of two patents, U.S. Patent No. 5,167,663 (“the '663 patent”) and U.S. Patent No. 5,312,406 (“the '406 patent”).
