This is an application for a mandamus to compel the defendant, who is county clerk of Nance county, to give-notice of an election for register of deeds of said county at the election to be held therein November 3d, 1885. At the last session of the legislature an act was passed by both branches of the legislature creating the office of register of' deeds in counties having not less than fifteen thousand inhabitants.
