Application for writ of mandamus. The relator is plaintiff in a civil action triable by jury. The case is at issue, and ready for trial in the superior court of Whatcom county. The respondent is judge of that court. September 5, 1903, Was a day appointed for setting jury cases for trial in that court. On that day the parties to said action appeared in court, and the relator requested the court to set the case for trial.
