MEMORANDUM OPINION AND ORDER

LARKINS, District Judge:

This cause is before the Court in an action by Thomas Ray Buchanan to set aside an allegedly illegal sentence imposed by this Court on October 19, 1971 pursuant to the revocation of a period of probation which had been imposed by this Court on November 5, 1970. The Court has treated the paperwriting filed in this case as a motion filed within 120 days, as provided for by the law, seeking to set aside an illegal sentence under Rule 35, Federal Rules of Criminal Procedure.
