In this action of tort by a minor (hereinafter called the plaintiff) to recover for personal injury from being hit by a golf ball, and by his father for consequential damage, verdicts were ordered for the defendant. In Ms answer the defendant pleaded the plaintiff’s contributory negligence and Ms assumption of risk. There was evidence that the plaintiff, a boy of ten years, was injured on June 19,1954, while “shagging” golf balls on the premises of a private golf club in Weston.
