GRAVES, Justice.

This is a case involving the application of KRS 382.440 (memorandum of actions affecting real property_). The Court of Appeals determined that Appellees were subsequent purchasers under KRS 382.440(1), and thus the trial court erred in refusing to discharge a lis pendens notice filed by Appellants on Appellees’ real property. However, we hold that the trial court erred in finding that Appellants, as general creditors, were entitled to file a lis pendens affecting the title of the property in question.
