U.S. Bank, NA (the bank), appeals from an order of the McCracken Circuit Court that had the effect of denying the bank’s Kentucky Rules of Civil Procedure (CR) 60.02 motion to set aside the final judgment in its foreclosure action against Michael Scott Hasty and Cynthia Hasty and amend its complaint to name Heights Finance Corporation as a party to the proceedings. The bank sought to reopen the foreclosure proceedings because Heights Finance had filed a judgment lien against the subject property subsequent to the filing of the bank’s foreclosure action, but…
