Motion by the defendant for an extra allowance under section 1513 of the Civil Practice Act upon the ground that this case was a “ difficult and extraordinary ” one within the meaning of that section.
This action was brought by the plaintiffs to restrain the defendant from trespassing upon a portion of a lake in Sullivan County, and for a declaratory judgment to the effect that the defendant was without right to enter or go upon the same.
