DECISION AND ORDER ON THE REPORT OF THE SPECIAL MASTER

D. BROCK HORNBY, District Judge.

In this corporate oppression case, I appointed Attorney George J. Marcus as Special Master to determine whether the corporation is financially able to purchase the oppressed shareholder’s shares and under what circumstances; and, if the corporation cannot do so, whether the controlling shareholder can. The Special Master filed his Report on September 14, 2009.
