Presently pending in this civil case are the motion of defendant Commissioners of Aberdeen (hereinafter the “Town”) for summary judgment, the motion of defendants Charles F. Penrow, Jr., Stephen Smith and Harry Gruber, members of the Aberdeen Police Department, for summary judgment, and various discovery motions. Memoranda in support of and in opposition to the motions have been filed by the parties and reviewed by the Court.
