This action arises from defendant Bath Iron Works Corporation’s (“BIW”) disposal of industrial waste at a landfill in Bath, Maine previously owned and operated by Eugene Dauphin. 2 The plaintiffs in this action are various individuals who live or have lived in the Tarbox Hill area of Bath, a residential community allegedly affected by leachate from the so-called Dauphin landfill.
