MEMORANDUM OPINION

This case is presently before the court on the defendants’ motion for summary judgment. For the reasons set forth below, the court will grant in part and deny in part the defendants’ motion.
I. Factual and Procedural Background
Beacon Wireless Solutions, Inc. (“Beacon”) and Beacon Wireless Europe (UK) Limited (“Beacon Europe”) (collectively, “plaintiffs”) initiated this civil action on March 21, 2011 against Garmin International, Inc.
