The Commercial Union Assurance Company, Limited, brought this suit against the Gulf Refining Company for the recovery of damages in the sum of $2,500, sustained by a boat named Lynn II, owned by F. F. Arnim, alleging that it had issued a policy of insurance covering said boat, that the same had been damaged by reason of a fire communicated to it from gasoline resulting from the negligence of the defendant, and that the claim of the said Arnim for damages on account of said negligence had been assigned to plaintiff.
