We issued our original opinion in these cases on December 30,1998. Appellant/rela tor, D. Wilson Construction Company (“Wilson”), subsequently filed motions for rehearing. We deny Wilson’s motion for rehearing in Cause No. 13-98-439-CV. We grant Wilson’s motion for rehearing in Cause No. 13-98-373-CV, withdraw our opinion of December 30, 1998, and substitute the following as the opinion of the Court.
