ROGERS, Circuit Judge.
This is a suit in admiralty, commenced by the libelant, as owner of the barge Daniel B. Flannery, to recover damages sustained by her while moored at the end of a pier in the North River, New York City, as the result of a collision with the tug Athens.
It appears that in June, 1918, the libelant chartered the barge to Burns Bros. Ice Corporation for the purpose of carrying ice down the river.
