Pursuant to verdict, the defendant-appellant, Fernando Jimenez, was convicted in the district court of delivering a controlled substance, marijuana, in violation of the Nebraska Uniform Controlled Substances Act, Neb. Rev. Stat. §§ 28-401 through 28-445 (Reissue 1989 & Cum. Supp. 1992), more specifically §§ 28-405(c)(10) [Schedule I] and 28-416(l)(a).
