This matter is before the Court for a determination of Defendant NCR Corporation’s (NCR) Motion for Summary Judgment (doc. # 12). The present suit was filed pursuant to 28 U.S.C. § 1343 1 and 29 U.S.C. § 626(c) 2 , the civil enforcement provision of the Age Discrimination in Employment Act (ADEA), 29 U.S.C. § 621 et seq.
