HALE, District Judge.

These two cases were heard together, and are to be decided upon the same evidence. They make practically but one case.

In the first case, Thomas B. Mehaffey, in behalf of the schooner Crescent, brings this proceeding against the steamtug Somers N. Smith to recover damages alleged to have been sustained by that schooner by the negligence of the said steamtug in towing said schooner upon Gangway Ledge, in the entrance to the harbor of Long-Cove, in the town of St. George, December 8, 1901.
