Action on a promissory note, executed by Webster, as member of the firm, in the firm name of Thacher, Webster & Ellison. Thacher and Ellison denied *130the execution of the note under oath. The firm was engaged in the insurance, real estate and collecting business in Kansas City. The cause was referred to a referee, who made a special finding of facts, as follows:
