THAYER, Circuit Judge.

This is a suit for the infringement of letters patent No. 416,346, issued to Henry M. Rose, for an improvement in disk harrows, on December 3, 1889. Julius Sander, the defendant below, who is the appellant in this court, sold harrows that were manufactured in accordance with the specifications of letters patent No. 645,818, issued to A. Eindgren on March 20, 1900, for an improvement in disk harrows.
