Reversing in part, affirming in part.

After their demand that the Fiscal Court institute a similar action had been refused, appellees, citizens and taxpayers of Fayette County, instituted suit against appellant, Thompson, former sheriff of Fayette County, and appellant, Ohio Casualty Insurance Company, the surety on his bond, to recover certain sums .of money which were alleged to have been paid to, or retained by Thompson as sheriff, (1) as salary in excess of the constitutional limit;.
