This is an application for leave to appeal from a denial of post conviction relief.

The applicant was convicted of first degree murder by Judge Dulany Foster on February 3, 1961. A motion for new trial was filed on the same day. On February 5, 1962, 1 the motion was withdrawn, the verdict of guilty of first degree murder was stricken out, a verdict of guilty of second degree murder was entered, and the applicant was sentenced to eighteen years in the Maryland Penitentiary.
