This is an appeal from the judgment and a sentence of ten years entered on a plea of guilty to a charge of simple assault.
In the late evening of May 3, 1963, the defendant (Charlie Daniel Gleaton) and a codefendant entered a tavern in Denton ostensibly for the purpose of inquiring as to the whereabouts of another person. While there, they became involved in a fight with a group of patrons and bystanders.
