Appellant, Michael G. Smith, sued appel-lees, David L. Sneed, D.O., individually and d/b/a the South Austin Family Practice Clinic (collectively “Sneed”), alleging negligence, negligent misrepresentation, and false imprisonment. The district court granted summary judgment in favor of Sneed. Smith now appeals, arguing in three points of error that the trial court erred in concluding that: (1) Sneed did not owe a duty to Smith; (2) Smith could not maintain an action for negligent misrepresentation against Sneed; and (3) Smith could not maintain an action against Sneed for false…
