This is an action brought by the city of Spokane, a municipal corporation, for the purpose of foreclosing a lien created by an assessment for street grading, against the property of the respondents. The complaint was in the regular form and to it a demurrer was interposed, alleging, (1) that the complaint did *669not state facts sufficient to constitute a cause of action against the defendants; and, (2) that this action was not commenced within the time limited by law.
