This matter comes before the Court on Defendants Donald and Connie Brink-man’s motion to dismiss pursuant to Federal Rule of Civil Procedure 12(b)(1), (b)(3), and (b)(7), and Plaintiff California Casualty & Fire Insurance Company’s motion for summary judgment.
