McGOWAN, Circuit Judge:
This is a proceeding initiated by petitioner to review an order of the National Labor Relations Board which found the intervenor employer guilty of certain violations of Section 8(a) (1) and (3) of the Act, but dismissed other portions of the complaint which alleged Section 8(a) (5) violations as well as other infractions of § 8(a) (1) and (3). Because intervenor voluntarily complied with the affirmative aspects of the Board’s order, only the Board’s failure to sustain the other charges in the complaint is at issue here.
