This is an appeal from a judgment in the district court of Jefferson county. It appears that the defendant in error had been in .possession of a tract of land in said county for several years under leases ei lecuted by Willie Alexander, a full blood Indian of the Five Civilized Tribes, said lauds being the home-si ead allotment of said Alexander.

On the 29th day of October. 1918, and while the defendant in' error was in possession of said lands under a previous lease, the allottee executed a new lease to defendant in error to commence on January 1, 1919. and to expire on…
