The defendant in error, Penny, brought an action in forcible entry and detainer, before a justice of the peace against plaintiffs in error, Richardson, Munroe and Murray, to recover possession of eighty feet off the east end of a lot numbered one, in block numbered twenty-eight, in the city of Perry, in Noble county, Oklahoma. Penny recovered judgment before the justice, and Richardson et al., appealed the case to the district court, where the case was again tried and judgment rendered in favor of Penny.
