MEMORANDUM OPINION AND ORDER
ASPEN, District Judge:
This twelve-count action was brought under 42 U.S.C. § 1983 (“Section 1983”) by a group of individual livery and taxicab operators and three corporate livery services against the City of Chicago, and against the Superintendent of the Chicago Police Department and the Commander of Police for the 16th Police District in their official capacities. (Defendants collectively referred to as “City”).
