Paul Delo, the Superintendent of the Poto-si Correctional Center, (hereinafter “the state”) appeals the district court’s order granting Emmett Nave’s petition for a writ of habeas corpus on ten grounds of ineffective assistance of counsel. Nave cross-appeals the court’s decision denying him relief based on two additional allegations of trial error. We reverse the district court’s decision to grant the writ and affirm the decision with respect to the issues raised in Nave’s cross-appeal.
