1. Whether, in the exercise of due care required of the operator of an automobile along a public highway to prevent a collision with an obstacle ahead on the highway, the operator can within a certain distance bring his automobile to a stop, is dependent upon a number of factors, such as the size and weight of the automobile, the speed at which it is being operated, the condition of the tires and of the brakes, the nature and condition of the roadway, etc. Thus, where the operator of an automobile traveling 40 miles an hour along a public road, after coming around a curve, observed another…
